Terms of Sale

Effective date: 15.10.2026

These Terms of Sale apply to purchases of artworks, editions, sculptures, designer toys, and other physical collectibles (“Items”) through https://oppsgallery.art or arranged directly with us following an enquiry through the website.

About us

The website is operated by OOPS GALLERY (“we”, “us”, or “the Gallery”).

Business address: 15, 2 Soi Ruamrudee Lumphini, Pathum Wan Bangkok 10330, Thailand
Email: ooopsgallery@gmail.com

These terms apply to purchases where the Gallery is the seller. If we act as an agent for another seller, we will identify that seller and explain the arrangement before you order.

Orders and acceptance

You may purchase an Item using online checkout where available or by contacting us to arrange a purchase.

Listings and quotations are subject to availability. Submitting an order or receiving an automated payment acknowledgement does not, by itself, mean that we have accepted your order. A contract is formed when we send written confirmation expressly accepting it.

Before acceptance, we may decline an order because an Item is unavailable, payment cannot be verified, delivery cannot be arranged, or a material listing error has been identified. If we decline an order after receiving payment, we will refund that payment promptly.

We will not substitute an Item or increase an agreed price without your consent.

You must have legal capacity to enter into a purchase contract. If purchasing for a business or another person, you confirm that you are authorised to do so.

Item descriptions and condition

Please review the Item’s description, photographs, dimensions, materials, edition details, and any condition information before purchasing. Contact us if you need additional photographs or a condition report.

We will identify whether an Item is an original work, edition, reproduction, or collectible. An artist or brand name may describe a collaboration, licensed design, or manufacturer’s attribution; it does not necessarily mean that the Item was personally made or signed by that artist.

We will disclose known material damage, restoration, missing components, and packaging limitations. Original boxes, certificates, signatures, accessories, and framing are included only where expressly stated.

Colours may vary between screens and lighting conditions. Dimensions are approximate unless stated otherwise. Such variations do not excuse a material difference from the agreed description.

Authenticity and ownership

We warrant that Items sold by us are authentic as described and that we have the right to sell them. Any certificate or provenance documentation included with a purchase will be identified before the sale.

If you reasonably believe an Item is not authentic or has been materially misattributed, contact us with the supporting information. We will investigate in good faith and may arrange an independent assessment at our expense.

If an Item is established to be inauthentic or materially misattributed, we will accept its return at our expense and refund the purchase price and associated delivery charges. This process does not restrict any other rights or remedies available under applicable law.

We make no promise about future market value, investment performance, or resale opportunities.

Prices, taxes, and payment

Prices are quoted in $ USD. Displayed prices include applicable sales taxes. Shipping, insurance, and any additional agreed services will be itemised at checkout or in a written quotation before you commit to the purchase.

We accept card payments through Stripe and payments through PayPal, subject to availability. Your bank or payment provider may apply its own currency conversion rates or fees.

Payment is due in full before dispatch unless we agree to a different arrangement in writing. Any deposit, instalment schedule, or reservation arrangement must state its payment deadlines and cancellation conditions before you agree to it.

If a material pricing error is identified before acceptance, we will give you the choice of proceeding at the corrected price or cancelling for a full refund.

Shipping and international orders

We offer international shipping, subject to destination restrictions, carrier availability, and any applicable export or import requirements.

Delivery methods, charges, insurance arrangements, and estimated timing will be confirmed after purchase. Estimates are not guaranteed delivery dates unless we expressly agree otherwise.

For international orders arranged by us, the Gallery is responsible for import duties, customs charges, and local import taxes. We will arrange and pay these charges, either directly or through our delivery partners. If a carrier requests payment from you, contact us before paying. If you have already paid a charge for which we are responsible, provide the receipt so we can reimburse you.

Please provide accurate delivery details and any information reasonably required for customs clearance. We will not knowingly undervalue shipments or provide inaccurate customs declarations.

If delivery is delayed, we will provide an update and explain the available options. Your rights concerning late or failed delivery under applicable law remain unaffected.

Delivery, collection, and risk

We will arrange packaging appropriate to the Item and its journey.

Ownership passes to you once we have received full cleared payment and the Item has been delivered or collected.

Collection, where available, must be arranged in advance. Any storage charge or collection deadline must be disclosed and agreed before it applies.

Damage, defects, or incorrect Items

Please inspect your purchase reasonably promptly after receipt. If an Item arrives damaged, is incorrect, or differs materially from its agreed description, email us with your order reference and, where reasonably possible, photographs of the Item and packaging.

Please retain the packaging while we arrange an assessment or collection. Do not attempt repairs or send the Item back without contacting us first.

We ask for prompt notification to help resolve shipping claims, but a delay in reporting does not remove your statutory rights. Your remedy against us is not dependent on a carrier or insurer accepting a claim.

We will provide the repair, replacement, price reduction, refund, or other remedy required by applicable law. We will pay reasonable return costs for damaged, defective, incorrect, or materially misdescribed Items.

Cancellation

You may request cancellation before dispatch. For standard Items, we will cancel and refund the order if it has not yet been dispatched.

Please return all included accessories and documents and use the original packaging where reasonably possible, or equally protective packaging. You may inspect the Item as reasonably necessary to assess its nature, characteristics, and condition. Where permitted by law, we may deduct an amount reflecting diminished value caused by handling beyond that necessary inspection.

Any statutory cancellation or withdrawal right applies independently and takes priority where it gives you greater protection. Where required, we will provide the applicable cancellation information and model withdrawal form before the contract is formed.

Refunds

Refunds will normally be made to the original payment method.

For cancellations under section 9, we will issue the refund within 30 calendar days after receiving your cancellation notice. Unless applicable law requires earlier payment, we may withhold the refund until we receive the returned Item or evidence that you have sent it back, whichever occurs first.

For other refunds, we will comply with the applicable legal deadline and confirm the expected processing time. Your payment provider may require additional time to credit your account. We do not charge a refund administration fee.

Copyright and intellectual property

Purchasing an Item transfers ownership of the physical Item only. Copyright, trademarks, image rights, and other intellectual property rights remain with their respective owners unless expressly transferred in a separate written agreement.

The purchase does not grant a licence to reproduce the artwork, manufacture copies, or use its imagery commercially. Any uses permitted by applicable law remain available to you.

Our responsibility

We are responsible for fulfilling the contract and for breaches of our legal obligations. Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or limited.

Nothing in these terms limits mandatory consumer rights concerning title, authenticity, description, quality, delivery, cancellation, or remedies.

Art and collectibles may change in value. We are not responsible for market movements or a failure to achieve an anticipated resale price.

Events beyond our reasonable control

If an event beyond our reasonable control affects fulfilment, we will notify you, take reasonable steps to reduce its effects, and provide revised delivery information.

This does not remove your legal rights to cancel or receive a refund for delayed or unfulfilled orders.

Personal information

We use personal information to process payments, fulfil orders, arrange delivery, provide customer support, and meet legal obligations. Further details are set out in our Privacy Policy at https://oppsgallery.art/privacy.

Complaints and governing law

For questions or complaints, contact ooopsgallery@gmail.com with your order reference and a description of the issue. We aim to respond within 14 business days.

These terms and purchases from us are governed by the laws of Thailand.

If you are a consumer, this choice of law and courts does not deprive you of protections or rights available under the mandatory laws applicable to your purchase.

Changes to these terms

The version provided to you before you place your order applies to that purchase. Later updates apply only to future orders unless you expressly agree otherwise.

Any transaction-specific terms must be disclosed and agreed before the contract is formed. No transaction-specific term overrides mandatory consumer protections.
