Privacy Policy

OOPS Gallery respects the privacy of our visitors, customers, collectors, and artists. This Privacy Policy explains how we collect, use, disclose, and protect personal information in connection with oppsgallery.art, artwork enquiries, purchases, and related gallery services.

Information we collect

Depending on how you interact with us, we may collect:
  • Contact information: your name, email address, telephone number, and correspondence.
  • Purchase and delivery information: billing and shipping addresses, artwork purchases, order history, delivery instructions, and information needed for invoices, customs, or insurance.
  • Payment information: payment status, transaction references, refunds, and relevant billing information.
  • Collector preferences: artists or artworks you enquire about, collecting interests you choose to share, and communication preferences.
  • Technical information: IP address, browser and device information, website activity, and information collected through cookies or similar technologies, where used.
  • Artist information: biographies, professional contact details, artwork information, and materials supplied for gallery representation or publication.

We receive information directly from you and, where necessary, from payment providers, delivery partners, or a person arranging a purchase or delivery on your behalf.

Please do not send sensitive personal information unless we specifically request it for a lawful and necessary purpose.

How and why we use information

We use personal information for the following purposes and legal bases, as applicable:
  • Enquiries and purchases: to answer questions, arrange sales, process payments, deliver artworks, and handle refunds or support. This processing is necessary to enter into or perform a contract with you.
  • Legal obligations: to maintain required accounting and tax records and comply with lawful requests.
  • Gallery administration and security: to manage correspondence, maintain our website, prevent fraud, and establish or defend legal claims. We rely on legitimate interests where these do not override your rights.
  • Optional communications: to send newsletters, exhibition invitations, and artwork updates with your consent where required. You may unsubscribe or withdraw consent at any time.
  • Optional cookies and tracking: to provide analytics or advertising features, where used and where the required consent has been obtained.

We identify information required by law or necessary for a transaction when we request it. Without necessary contact, payment, or delivery information, we may be unable to complete your purchase or provide the requested service. Optional marketing consent is not a condition of purchase.

Payments

Payments are handled through Stripe and Paypal.

No card information is stored by the gallery.

Payment providers may process information independently for payment security, fraud prevention, and legal compliance.

Please do not send card security codes or complete card details by email or through general enquiry forms.

When we share information

We share information where necessary for the purposes described above with:
  • Payment processors and banks.
  • Shipping companies, art handlers, customs agents, and insurers.
  • Website hosting, technical support, and other service providers used to operate the gallery.
  • Professional advisers, including accountants and legal advisers.
  • Artists or their representatives where necessary to fulfil a commission, arrange direct delivery, or provide agreed artwork documentation.
  • Public authorities where disclosure is legally required.

We limit disclosures to information relevant to the recipient’s role. Where providers process information on our behalf, we require appropriate confidentiality and data protection arrangements.

We treat collector identities, purchase histories, and private correspondence as confidential. We do not publish a customer’s name, collection details, or testimonial without permission unless disclosure is legally required.

Information relevant to an unresolved dispute or legal obligation may be retained longer. We may keep a limited record of an unsubscribe request to respect your communication preferences.

When information is no longer required, we delete, securely destroy, or anonymise it.

International processing

Some providers or delivery partners may process information outside Thailand.

Where a transfer is subject to Thailand’s PDPA, we use an applicable lawful transfer mechanism and required safeguards. Contact us for information about arrangements relevant to your data.

Security

We use appropriate organisational and technical measures to protect personal information against unauthorised access, loss, misuse, alteration, and disclosure. Access is limited to people who need it for their work.

No online system can guarantee absolute security. Where a personal data breach requires notification, we will notify the relevant authority and affected individuals as required by law.

Your privacy rights

Subject to the conditions and exceptions under applicable law, you may request access to or a copy of your information, correction, deletion or anonymisation, restriction of processing, or data portability. You may also object to certain processing and withdraw consent where processing relies on consent.

You may object to direct marketing at any time. Withdrawing consent does not affect processing that was lawful before withdrawal.

Contact us. We may ask for information reasonably necessary to verify your identity and will respond within the applicable legal timeframe. If we cannot fulfil a request, we will explain why.

You may also lodge a complaint with Thailand’s competent data protection authority through the Office of the Personal Data Protection Committee.

We may update this policy to reflect changes in our services, practices, or legal requirements. The effective date appears above. Where required, we will provide additional notice or obtain consent before introducing new processing.

Copyright Notice

Artworks and other third-party materials remain subject to the rights of their respective owners.

Ownership of content

Original text, photographs, graphics, and other website materials are owned by OOPS Gallery or used under permission or licence, as applicable.

Copyright in artworks displayed on oopsgallery.art remains with the relevant artist or other copyright holder unless expressly stated otherwise. Gallery representation, possession of an artwork, or its display on this website does not by itself transfer copyright to OOPS Gallery.

Artist names, artwork titles, photographer credits, and other rights information should be read together with this notice.

Viewing and sharing

You may browse the website and share links to its public pages for personal, non-commercial purposes.

Sharing a link does not grant permission to download, repost, reproduce, or commercially exploit the artwork or other content on that page. Any expressly stated licence or written permission governs the use it authorises.

Nothing in this notice limits uses permitted by applicable law.

Reproduction and other uses

Except where permitted by law or an applicable licence, prior written permission from the relevant rights holder is required to:
  • Reproduce, publish, distribute, or modify artworks, photographs, or website content.
  • Use content in advertising, merchandise, publications, or other commercial materials.
  • Create reproductions or derivative works, or use artwork images to create or market digital tokens such as NFTs.
  • Remove or alter copyright notices, watermarks, or attribution.

Credit alone does not replace permission.

Purchasing an artwork

Unless a separate written agreement expressly provides otherwise, purchasing an original artwork or a physical print transfers ownership of the purchased object only.

The purchase does not transfer copyright or grant reproduction, publication, commercial licensing, or other intellectual property rights in the artwork.

Any rights granted with a digital artwork, licensed image, or other digital product are limited to those expressly stated in its purchase or licence agreement.

Press and permission requests

For publication, editorial use, image licensing, or other permission requests, contact us and include:
  • The artwork or material requested and its website URL.
  • The proposed use, publication or platform, and intended audience.
  • The required image format, distribution, and duration of use.

Where OOPS Gallery does not control the requested rights, we may refer your request to the relevant artist or rights holder. Permission takes effect only when confirmed by the authorised rights holder.

Approved use must comply with any agreed credit, image alteration, and publication conditions.

Reporting a copyright concern

If you believe material on this website infringes your copyright, contact us with:
  • Your name and contact information.
  • Identification of the protected work and your relationship to its rights holder.
  • The URL and description of the material concerned.
  • An explanation of the alleged infringement and any supporting information.

We will review the report and may request clarification, contact the relevant contributor, or restrict or remove material as appropriate.
